Untimely Motion Documents
Sometimes other parties or attorneys will file documents late or “untimely.” For all motions, that would mean anything filed less than 7 days before the hearing. There could also be situations where the non-motioning party may make a motion for “new issues” less than 14 days before the hearing, which would also be late. In those situations, our attorney may object to those documents on the record at the motion hearing. However, another option would be to formally object to what has been filed. Here is an example that Jason did on a case that can be used as an example:
