Early Case Management Process (ECM) – FOR ALL NEW CASES

Major Points:

  • They require ICMC within 3 weeks of filing
  • No temp orders entered before ICMC
  • Mediation SHALL occur within 3 weeks of ICMC
  • No contested hearings may be scheduled until after ADR

At ICMC Hearing (usually about an hour long):

  • MUST HAVE TYPE OF ADR AND NEUTRAL SELECTED BY THE TIME OF THE ICMC HEARING
    • ENE – if parties have chosen ENE, the Court maintains the evaluators’ schedules and will schedule the ENE at the ICMC
    • Mediation – if parties have chosen mediation, the court does NOT maintain their schedules and the attorneys MUST present date and time of scheduled mediation session at the ICMC.
      • If you have not already arranged a date and time for mediation, the Court may require you to call the mediator during the hearing to schedule.
  • Be prepared to discuss details of the case like each party’s proposal re: custody and parenting time, issues that are clearly not agreed upon.
  • Court may issue order regarding custody, parenting time, or finances if the party’s say they are in agreement, or Court may press parties to see if they’ll agree so court can issue an order.

Removing a Judge

In addition to the notice to remove, Olmsted County requires that you complete a proposed order and submit it to the Court. Both of these templates are in mycase.

Mediators

They have their own “roster” of approved mediators. It is possible the Court could tell you that you cannot use a mediator that isn’t on their roster. Be prepared.

Correspondence for Judicial Approval

DO NOT use the filing code “Correspondence for Judicial Approval” under any circumstances. Only the “Correspondence” filing code is used within the Third District and is programmed for the document to be routed appropriately.

Continuance Request

Requests to continue or reschedule a hearing should be submitted using the appropriate continuance request filing code, not correspondence. Using the appropriate filing code will ensure your request is reviewed in a timely manner and routed appropriately. For requests within 21 days of the notice of trial and/or 14 days of the notice of all other hearings use “Request for Continuance”. For all other requests outside timelines use “Request for Continuance Needing Judicial Approval”. Do NOT use “Correspondence” for continuance requests.  Additionally, this request must state the other parties’ position. For all CSM Magistrate hearings please use “Request for Continuance” regardless of the timeline.

Proposed Order

Do not include the word “proposed” in heading of proposed orders. Once these have been signed by a judicial officer, they are no longer considered proposed.

Cover Letters to Court

Correspondence/cover letters only stating which documents are enclosed is not necessary. Please do not file.

Filing copy of an opposing party’s document

When filing a copy of an opposing party’s document, use the filing code “Other Document” with a comment of “Copy of name of document”. For example, when filing the respondent’s Answer use “Other Document”, with a comment “Copy of Answer”.

Date of Valuation

Default is initial ICMC hearing date, but that can be rebutted.

Pre-Trial

Always in person and they want you to plan on being there for half a day trying to settle before/during/after the pre-trial

Trial

All trials (even one day trials) are scheduled as on-call for an entire week. Must keep the whole week blocked off.

Post-Hearing Submissions / Closing Arguments / Briefs

When a matter is going under advisement, and the judge orders submissions (or a “closing argument”) be submitted after the hearing, please use the filing code “Briefs” to ensure the document is routed to the judge taking the matter under advisement.

Request for Remote Witness Appearance

If you are requesting that a witness be allowed to appear remotely for a hearing, you must use the filing code “Correspondence” with a comment of “Witness Remote Appearance Request”.
