How/When to Introduce Temporary Relief to Clients (Temp Relief SOP)

Scope:

  1. Any new dissolution
  2. Any custody case

Timing:

  1. Trigger event: we serve or receive A & CP
  2. Paralegal sets an initial attorney call w/ client within 1 week of serving or receiving A & CP. Call needs to be on the calendar for 1 hour. Include in calendar entry the following discussion topics:
    • Filing/not filing initial pleadings
    • Mediation
    • Informal/Formal Discovery
    • Experts
    • Temp relief specifics:
      • It’s an option for any issue
      • What requests can be made
      • How long it takes
      • Discuss how much it costs
      • The fact that it can be done at any time, not necessarily right now
      • Go over pros and cons
  3. Attorney adds notes to MyCase clearly stating the client’s position on temp relief and lets para know that is available for review.
