Family Law – ICMC Data Sheet

Many counties in the 3rd district, and some in the 1st district or 5th district require an ICMC hearing.  In order to be prepared for this, the ICMC Data Sheet must be prepared.  Each county has different deadlines for when the ICMC data sheet must be and emailed to the court, but it is usually 2-7 days prior to the hearing.

  1. As soon as we get the Order for an ICMC or the ICMC gets scheduled, we should send out the ICMC Data Sheet to the client to complete as much as they can or ask them to provide answers for as much of it as possible.
    1. The ICMC data sheet differs from county to county and oftentimes the court will serve a blank copy of their ICMC data sheet with the Order for ICMC or Notice of Hearing. Review MyCase Templates where we have saved a few different county specific ICMC templates
      1. If the county does not send a specific ICMC data sheet to complete, you can google ICMC Data Sheet (County Name) and may be able to find a county specific one that way. Otherwise, you can use these general ones:
        1. First District ICMC
        2. Fifth District ICMC
  2. When you send out the ICMC data sheet to client, also note that there are documents the client needs to provide (3 months paystubs, proof of income, taxes)
  3. Tell the client they’ll just be doing a rough draft and we will finalize the document and submit it to the Court.
  4. Tell the client to have the document completed and income/taxes documents sent back to you at least 2 days before the due date for the ICMC data sheet so you have times to finalize it.
  5. Client does rough draft of it (or provides the info needed)
  6. Client emails draft back to paralegal
  7. Paralegal edits it
  8. Paralegal sends to lawyer for review.
  9. Lawyer edits/ok’s it
  10. Paralegal emails the finalized ICMC data sheet and accompanying documents to court and the opposing attorney. NOT EFILED, NOT ESERVED. Only emailed
    1. The email address you should send the ICMC data sheet to will usually be included in the Notice of Hearing, Order for ICMC, or on the ICMC data sheet itself. If you can’t find an email, ask the team or call and ask court admin.

Don’t forget to include the required supporting document which are usually:

  1. Pay stubs for the last 3 months of employment.
    1. If self-employed, please attach a statement of receipts and expenses for the past six months.
  2. Please attach your most recent Federal Tax Return with all attachments, including W-2s and 1099’s as applicable.
    1. Please attach any unemployment compensation statements or worker’s compensation statements and all other income received during the last three months, including any public financial assistance in money or in-kind services (grants, heating assistance, medical assistance, etc).

 

Example Email to Client w/ ICMC sheet to complete:

Attached is a form called the ICMC data sheet.  ICMC is the Initial Case Management Conference that some counties require you to attend and complete this form beforehand.  It’s important we start off on the right foot with the Judge and comply with their order that this is filled out as best as possible.

Enclosed is a form we need to fill out and submit by (DATE 7/ 5DAYS BEFORE), so we ask that you take a look and fill out what you can or provide us with the information to complete it. Some of the issues are legal questions that we will take care of, but things like monthly expenses, accounts, etc, you will need to fill in or provide the information for (unless we already have it on file).

If you don’t feel comfortable typing, that’s ok, just hand write the answers, and we’ll add them to the document.

We also need the following documents:

  • 3 last months of paystubs.
  • Copy of the most recent federal tax return (including W-2’s and 1099’s)
  • Proof of any income
