Summary
An applicant with a felony conviction under Minnesota law or the law of another state or federal jurisdiction shall serve notice regarding their application for name change on the prosecuting authority that obtained the conviction. If the conviction is from another state or federal jurisdiction, notice must also be served on the Minnesota Attorney General. The prosecuting authority has 30 days to object to the name change application. The MTA is considered the application for name change and must reference the felony and that notice has been provided.
How to Provide Notice
To provide notice, complete the Felon Name Change Notice Form (#NAM104), attach the MTA, and mail it to the Prosecuting Authority along with an Affidavit of Service. The “application” that is referenced throughout NAM104 will be the MTA. You do not need to fill out an actual name change application.
For the majority of scenarios, the prosecuting authority will be the County Attorney’s Office in the County where the charges were out of. If the conviction is from another state or federal jurisdiction, notice must also be served on the Minnesota Attorney General at 1400 Bremer Tower, 445 Minnesota Street, St. Paul, MN 55101.

The prosecuting authority has 30 days to object to the name change application.
You must enter your name change information in the Name Change paragraph in the Findings of Fact section of the MTA.
Language for MTA
“Petitioner/Respondent wants to change his/her name to ____________________________. This name change request is made with no intent to defraud or mislead anyone. Petitioner/Respondent has been convicted of a felony. Notice of this request for name change has been given to the proper authority as required by Minn.Stat. § 259.13. An Affidavit of Service of the Notice marked Exhibit “A” has been submitted with this document.”
