Defining Case Stages

Pre-Filing: DO NOT USE 

Initial Pleadings: Just got case, waiting on intake, drafting initial pleadings, awaiting response to initial pleadings, remains here until discovery gets started, motion filed, mediation scheduled. 

Filed: DO NOT USE 

Mediation: Mediation is the next scheduled event. (If discovery is still ongoing, keep stage at Mediation) 

ENE: ENE is the next scheduled event. (If discovery is still ongoing, keep stage at ENE) 

Informal Discovery: Doing informal discovery and no other events are schedule (no mediation, no motion, no trial) 

Formal Discovery: Doing formal discovery and no other events are schedule (no mediation, no motion, no trial) 

Motion Pending: A motion hearing is scheduled (not been heard) with the Court and is the next thing to happen on the case. 

Drafting/Revising Proposal: A proposal is being drafted or has been drafted and is going back and forth between attorney and client or attorneys. 

Trial: Trial is the next thing happening on the case (no mediation or no motion). Even if discovery is ongoing, keep stage as trial.  

QDRO Only: Finally an easy one – everything is done but QDRO.  

Wrap Up: Any final tasks beyond SREDJ, QCD, Qdro. Examples would be waiting on equalization payment, waiting on refi, getting name off a car, exchanging personal property, etc, etc. 

QCD/SREDJ: Only thing left to do is draft/finalize real property documents 

Holding Pattern – Under Advisement: Had a hearing (motion or trial) and are waiting for the Judge’s order.  

Holding Pattern – Expert Report: Nothing moving on the case. Waiting entirely on a report from expert.  

Holding Pattern – Per Client: Client is requesting we not work on the file for the time being. Checking in with client once a month. 90 days w/ no contact, msg to client saying we need to hear from them in 14 days or we will assume they are no longer proceeding with the whatever and will refund trust.  

Holding Pattern – Other: Catch all, waiting for payment, client hired us in anticipation of OPA doing something/filing something so we are just waiting in case. Check in biweekly.
