Next steps after initial pleadings
Oftentimes after the initial pleadings have been completed (both petition and answer & counter petition), there is sort of a lull in the case or a question about “What’s next?” While each case is different and there are a variety of things that could happen next, there are 4 main options: Proposal, Discovery, ADR, or Temp Relief. This document outlines the types of cases where each of those options may be a good fit and also where those options may not work well.
Best practice is to set up a call with the client and the attorney after the initial pleadings are done so they can talk about these options for the next steps. However, it’s important that the paralegals and attorneys have an idea of what the best options may be so that the paralegal can give their suggestion and rationale to the attorney and then ultimately the attorney can give their suggestion to the client.
